DRUNK GOLFING LEADS TO DUI

Heading out on the golf course soon? If so, take a lesson from Gary Osborn from Southern California. Police were called after a woman woke up to find dried blood covering her face. She had no injury and her only memory was of playing golf with Mr. Osborn. At about the same time that the police received the call from the woman, The Club at PGA West security discovered Mr. Osborn passed out in front of a residence on the golf course, with a badly damaged golf cart nearby. There were no apparent injuries on Mr. Osborn either, but there was enough evidence for local law enforcement to take Mr. Osborn in on suspicion of DUI.

Are these charges going to stick? Time will tell, but a golf cart is a vehicle which means that the same DUI statute applies to golf carts that applies to cars. In fact, last year we blogged on getting a DUI on a bike! The golf cart case involves some problems for the prosecution, the most significant being establishing Mr. Osborn’s impairment at the time he drove the cart.

What does this mean for the rest of us? The good news for golfers is that police are not generally trolling local golf courses looking for golf cart DUIs. If you can avoid crashes, bloody faces, and ending up face-down in a stranger’s yard, the risk of a DUI is pretty low. However, and this is a big however, if you’re getting in a car to drive home after having a few cocktails on the course all bets are off!
