APPLE PULLS DUI CHECKPOINT APPS

Apple has given into a recent request by a handful of U.S. Senators to the smart phone industry to ban applications that provide DUI checkpoint information. Apple’s new guidelines state that “apps which contain DUI checkpoints that are not published by law enforcement agencies, or encourage and enable drunk driving, will be rejected.”

An experiencedDenver DUI attorney points out that this move by Apple runs contrary to U.S. Supreme Court rulings that have stated that checkpoints should be publicly advertised by law enforcement agencies in advance so as to provide motorists with an opportunity to avoid the checkpoint if possible, as it is considered a “seizure” under the Fourth Amendment of the U.S. Constitution.

In most cases, the offending apps were republishing the DUI checkpoint info that is already available to the public. While the senators’ request was to the “big 3,” only Apple has changed its guidelines. Google’s Android and RIM’s Blackberry still allow for DUI checkpoints apps for now
